These Terms of Service apply to your access to and use of the Humanoids Store, including browsing, creating an account, placing orders, purchasing products, purchasing subscriptions, and using any related services.
By using the Humanoids Store, you agree to these Terms. If you do not agree, do not use the Humanoids Store.
1. Legal seller and operator
The Humanoids Store is operated by Humanoids Studios SA, Cours des Bastions 13, 1205 Geneva, Switzerland.
In these Terms, “Humanoids,” “we,” “us,” and “our” mean Humanoids Studios SA.
U.S. website, customer-service, logistics, and fulfillment support may be provided on our behalf by Global Arts Services LLC, 1800 North Vine Street, Los Angeles, CA 90028, United States. Global Arts Services LLC provides operational support only and is not the seller of record unless expressly stated otherwise.
Our store is hosted on Shopify, which provides the e-commerce platform used to offer products and services.
2. Eligibility
By using the Humanoids Store, you represent that you are at least the age of majority in your place of residence or that you are using the Humanoids Store with the consent of a parent or legal guardian.
You may not use the Humanoids Store for any illegal or unauthorized purpose.
3. Products, availability, and descriptions
We try to describe and display products accurately. However, colors, dimensions, finishes, images, and descriptions may vary based on production, printing, photography, device display, or other factors.
Products may be limited in quantity and may be available only while supplies last. We may limit, refuse, or cancel orders where permitted by law, including orders that appear fraudulent, abusive, automated, placed by resellers, or inconsistent with stated purchase limits.
4. Prices, taxes, and charges
Prices are shown at checkout. Prices may change without notice before an order is placed.
You are responsible for applicable taxes, shipping charges, customs duties, import VAT, brokerage fees, and other charges unless checkout expressly states that they are included or prepaid.
5. Orders and order acceptance
An order is an offer to purchase. We may accept or reject an order where permitted by law.
After you place an order, you may receive an order confirmation. The confirmation does not guarantee availability or shipment. If we cannot fulfill an order, we will cancel it and issue any refund required by applicable law.
You are responsible for providing complete and accurate billing, shipping, account, and contact information.
6. Preorders and subscriptions
Preorder and subscription products may have estimated release or shipment dates. These dates may change because of production, printing, freight, customs, warehouse, carrier, or other issues.
If we cannot ship within the stated or legally required time, we will notify affected customers and provide cancellation, refund, or delay options required by applicable law.
Subscriptions sold through the Humanoids Store are fixed-term subscriptions unless the product page expressly states otherwise. They do not renew automatically unless you separately and expressly agree to automatic renewal terms.
7. Shipping and delivery
Shipping methods, charges, estimated delivery times, and available destinations are shown at checkout or in our Shipping Policy.
Delivery estimates are not guarantees unless expressly stated. We are not responsible for delays caused by carriers, customs authorities, weather, incorrect addresses, import review, or events outside our control, except where applicable law provides otherwise.
Risk, title, and delivery rules may vary by destination and mandatory consumer law.
8. Returns, refunds, cancellations, and withdrawal rights
Returns, refunds, replacements, cancellations, and statutory withdrawal rights are governed by our Refund Policy.
Except where required by applicable law or expressly stated in our Refund Policy, all sales are final.
Nothing in these Terms or our policies limits non-waivable consumer rights.
9. Accounts
You may need an account to access some features. You are responsible for maintaining the confidentiality of your login credentials and for activity under your account.
Notify us promptly if you believe your account has been compromised.
10. Intellectual property
All content on the Humanoids Store, including text, artwork, images, logos, trademarks, designs, product names, characters, graphics, page layout, and software, is owned by or licensed to Humanoids Studios SA or its licensors, unless otherwise stated.
You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, sell, resell, exploit, or use store content without prior written permission, except as permitted by applicable law.
11. User comments, reviews, feedback, and submissions
If you send comments, reviews, ideas, suggestions, proposals, or other materials to us, you grant us a worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, publish, translate, distribute, display, and create derivative works from those materials for business purposes, unless we agree otherwise in writing.
Do not send unsolicited creative submissions except through the Submissions section of the website and subject to the rules posted there. We are not obligated to keep unsolicited materials confidential, review them, return them, pay for them, or respond to them.
You are responsible for materials you submit and must not submit anything unlawful, infringing, misleading, defamatory, obscene, abusive, or harmful.
12. Prohibited uses
You may not use the Humanoids Store:
· for unlawful purposes;
· to violate intellectual-property, privacy, publicity, or other rights;
· to submit false, misleading, or fraudulent information;
· to upload or transmit viruses, malware, or harmful code;
· to scrape, crawl, harvest, or collect information without authorization;
· to interfere with store security or functionality;
· to harass, abuse, defame, threaten, or discriminate against others;
· to place fraudulent, automated, or abusive orders;
· to violate applicable laws or regulations.
We may suspend or terminate access for prohibited use.
13. Third-party services and links
The Humanoids Store may include links to third-party websites, platforms, payment processors, carriers, social media services, or other services. We are not responsible for third-party content, policies, practices, or services.
Your use of third-party services may be subject to their terms and privacy policies.
14. Privacy
Our collection and use of personal information is described in our Privacy Policy.
15. Errors and corrections
The Humanoids Store may contain errors, inaccuracies, or omissions relating to product descriptions, prices, promotions, shipping charges, transit times, availability, or other information.
We reserve the right to correct errors, update information, cancel orders, or refuse orders where permitted by law, including after an order has been submitted.
16. Disclaimer of warranties
To the maximum extent permitted by applicable law, the Humanoids Store and all products and services are provided “as is” and “as available,” except as expressly stated by us or required by law.
We do not guarantee that the Humanoids Store will be uninterrupted, secure, error-free, or available at all times.
Nothing in these Terms excludes warranties, guarantees, or rights that cannot be excluded under applicable consumer law.
17. Limitation of liability
To the maximum extent permitted by applicable law, Humanoids Studios SA and its affiliates, officers, directors, employees, agents, service providers, licensors, and contractors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or replacement costs arising from your use of the Humanoids Store or purchase of products.
Where liability cannot be excluded, our liability will be limited to the maximum extent permitted by applicable law.
Nothing in these Terms limits liability that cannot legally be limited, including liability for fraud, intentional misconduct, or rights that cannot be waived under mandatory consumer law.
18. Indemnification
To the maximum extent permitted by law, you agree to indemnify and hold harmless Humanoids Studios SA and its affiliates, officers, directors, employees, agents, service providers, licensors, and contractors from claims, losses, damages, liabilities, costs, and expenses arising from your breach of these Terms, your misuse of the Humanoids Store, your violation of law, or your violation of third-party rights.
19. Changes to the Humanoids Store and Terms
We may update, change, suspend, or discontinue any part of the Humanoids Store where permitted by law.
We may update these Terms from time to time by posting the revised version on this page. The revised Terms apply from the date posted, unless otherwise stated. Your continued use of the Humanoids Store after changes are posted means you accept the updated Terms.
20. Governing law and forum
These Terms and your use of the Humanoids Store are governed by the laws of the State of California, United States, without regard to conflict-of-laws rules, except that this choice of law does not deprive any consumer of any mandatory rights or protections that cannot be waived under applicable law. Such mandatory rights may include consumer-protection, cancellation, withdrawal, refund, shipping-delay, privacy, data-protection, product-liability, tax, customs, and unfair-commercial-practice rules that apply based on the customer’s location, the shipping destination, the seller’s location, or other legally relevant connection.
Where permitted by applicable law, disputes relating to these Terms or the Humanoids Store will be brought in the state or federal courts located in Los Angeles County, California. This forum selection does not limit any mandatory consumer jurisdiction rights that cannot be waived.
